Congressman Frank Guinta (NH) is introducing a MAJOR piece of legislation that would dismantle an unconstitutional gun control law that has been on the books since 1968.

The bill would allow Americans to purchase handguns across state lines from licenses gun dealers. The ban on interstate handgun purchases was put into place in '68 when background check records were written on paper. Today, all background checks are routed through the FBI and the checks are instantaneous.

There is no legal reason to keep the ban in place and just last year, a Federal judge agreed.

In 1968, Congress passed the Gun Control Act and made it illegal to buy a handgun across state lines.

Half a century ago, background checks were done by hand and documents were maintained on hard copies. While it was stupid to declare handguns to be an exception to the rule -- it was kept legal to buy rifles and shotguns across state lines -- there were legitimate concerns over whether the system could handle interstate sales.

Today, records are all digital and background checks are all routed through the FBI. It doesn't matter what state you are in, your records are instantly accessible.

The Supreme Court's Heller ruling declared that handgun ownership was a right. On that count alone, it is preposterous to treat handguns and long guns differently in interstate transfer law. The Gun Control Act of 1968 treated handgun ownership as a privilege, which it is not.

Additionally, because recordkeeping is digital and background checks are instantaneous, there is no legitimate government interest in maintaining the ban. A federal judge in Texas agreed and was the first one to rule the ban unconstitutional.

What this law does accomplish, however, is allow radical states to limit how many of its citizens are allowed to own handguns. In New York, it is next to impossible to legally buy a handgun. These regulations are only doable because federal law prohibits a New Yorker from purchasing that same pistol in Pennsylvania.

Representative Frank Guinta is introducing legislation to get rid of this antiquated law and treat handguns just like any other firearm.

As I said, the case is making its way through the courts on constitutional grounds, but there is already no logic behind maintaining the it. The ban will be overturned. You have the chance to craft the legislation that overturns it, as opposed to having a ruling forced upon you by the courts.
