Wow: Congress and Trump Could Undo Decades of Gun Control Laws

Activist judges in the 2nd, 3rd, 4th, 7th, and 9th Circuit Courts have now decided that the Second Amendment doesn't apply to more than 52% of Americans. They have upheld bans on semi-automatic rifles like AR-15s.

This is simply unconstitutional.

Congress and the Trump White House are still considering emergency action to undo this travesty. Right now, however, it is not a priority. They're focused on healthcare and tax reform.

But the truth is that they can attach one simple sentence to these spending bills and put an end to the assault weapon bans for good!

I am writing to demand that you intervene and restore Second Amendment rights to the half of Americans now deprived by liberal Appeals Courts.

Last month, the 4th Circuit Court of Appeals decided that Americans living in Maryland, Virginia, West Virginia, North Carolina, and South Carolina have no constitutional right to own an AR-15.

When you add in identical rulings in the 2nd, 3rd, 7th, and 9th Circuits, that means that more than 52% of Americans now have no right to own a semi-automatic firearm like an AR-15.

In 1939, the Supreme Court ruled in Miller v US that Americans have no "right" to own a sawed-off shotgun because they aren't useful in militia service. Only militarily-usable firearms were protected by the 2nd Amendment. Then in 2008, the Supreme Court expanded on this definition and ruled that Americans also have a right to own firearms for defensive purposes unconnected with militia service.

These 4th Circuit Judges ignored all of this and determined that American citizens have no right to own militarily-usable firearms. Using this logic, Americans are expected to show up for militia service with firearms that are not-suitable for the military...

Earlier this year, the Pentagon chose the Sig Sauer P320 as the new standard issue handgun. You and your colleagues get to decide whether to fund these purchases or not. The Judiciary has no right to intervene and decide what a suitable military weapon is.

Likewise, unelected judges have no constitutional authority to determine which firearms are suitable for militia use and which are not.

All of these activist anti-gun rulings can be undone by adding a single-sentence amendment to the next must-pass piece of legislation.

"Designation of Militia Rifles.  Any semi-automatic pistol, shotgun, or rifle, regardless of accessories, attachments, features, caliber, or gauge is authorized and appropriate for individual citizens to keep and bear for Militia and self-defense purposes under the Constitution and the laws of the United States."

As a member of Congress, you have the authority to make this declaration. You have the power to work with the President to set expectations for the "unorganized militia."

Not only will this one sentence slap down these activist judges, but it also will dismantle many of the unconstitutional gun control provisions enacted by the states.

There are a number of must-pass bills coming up in the next few weeks. You are currently in the amendment process for the American Health Care Act. After that, you'll move on t tax reform. Each of these can be passed through reconciliation. Each of these can serve as a vessel for this pro-gun amendment.

No more waiting. A right delayed is right denied!
