With the midterm elections now less than two months away, many of your colleagues are chomping at the bit to "do something" on gun control. They realize that they won't be able to pass a new gun ban, so they've arrived at a compromise: make it easier to suspend Americans' 2nd Amendment rights and confiscate their guns.

Make no mistake: This new legislation being introduced by Rep. John Katko is a clear danger to both our Republic and to our Constitutional rights.

Federal law deliberately makes it hard to disarm Americans. In order to be disarmed, you would need to (1) be convicted of a felony or domestic violence misdemeanor, (2) be involuntarily admitted to a mental hospital against your will, (3) adjudicated mentally defective by a court, (4) become a fugitive from justice, (5) relinquish your US citizenship, or (6) receive a dishonorable discharge from the military.

And it makes sense. In order for something to be a right, it needs to be protected from government interference. If the government can take away someone's firearms without even having to charge them with a crime, then the right to keep and bear arms ceases to exist.

This new bill would actually encourage gun confiscation orders based on nothing but hearsay. Family members, neighbors, community members, and perfect strangers would be able to petition police to confiscate an American's firearms. If a gun owner can't convince a judge why he or she deserves the right to keep and bear arms, they would be disarmed.

Prosecutors would not even need to charge the gun owner with a crime to get a confiscation order.

This proposal is not only illegal, but it is also unconstitutional. The bar for disarmament is deliberately set high because the 2nd Amendment is not a 2nd Class right. And yet, many in Congress is currently rallying behind this new confiscation plan.

I want to be completely clear: if you go down this path, you will seriously regret it. You need to be defending the right keep and bear arms, not looking for ways to weaken it.

You need to put a stop to this gun confiscation plan. You CANNOT allow the government's disarmament powers to be broadened.

When the founders ratified the phrase "shall not be infringed," they literally meant that the right to keep and bear arms shall not be infringed.

I understand that many of your colleagues have decided to turn their backs on the 2nd Amendment. They think that will win them re-election. They are wrong.

If you won't stand up for my Constitutional rights, then I am sorry, but I have no choice but to replace you with someone who will.
