On Wednesday evening, a deranged gunman walked into a bar in California with an illegally modified gun and started opening fire. He ended up killing 12 innocent people and wounding 25 more.

He was known to police. Previously, officers had been called to his home and had trained mental health professionals examine the man to see whether he needed to be institutionalized. After an exhaustive interview, they concluded that he did not qualify for institutionalization.

Many of your colleagues see this and are demanding that you make it easier for police to seize someone's guns and throw them in a mental institution.

I am writing to tell you that would be a grave mistake.

The 2nd Amendment protects an individual right to keep and bear arms, not a privilege. In order to suspend someone's constitutional rights, the government must sufficiently prove that they have a justification behind any disarmament order.

Right now, some of your colleagues are pushing for a vote on HR.5717, a bill to help implement nationwide adoption of "red flag" laws.

Instead of police needing to prove guilt or severe mental illness, they would be allowed to confiscate someone's firearms simply if a family member, friend, or neighbor asks them to. The gun owner would then have to go before a judge and prove that he or she deserves to have their rights back. If the judge disagrees, the disarmament order can be extended for 6-to-12 months.

All of this happens without the gun owner even being accused of breaking the law. They remain completely innocent, but suddenly without one of their God-given rights.

This week, a 60-year-old Maryland man was shot dead in his own home. He had committed no crime and was not insane. One of his family members asked police to confiscate his guns "just in case," and he refused to comply. During a struggle, he was shot and killed in his own doorway.

This is not the solution. Disarming innocent Americans is never the solution. Even suggesting that is a grave affront to the Constitution itself.

If you force HR.5717 through, then you are the one the Founders warned us about. If you pass this bill, then you are the reason for the words "shall not be infringed."

And I will not rest until you are defeated.
