Yesterday, your Democrat colleagues used the shooting in Pensacola, Florida to renew their calls for new gun control legislation. They didn't care that the shooting was a terrorist attack perpetrated by a Saudi Arabian soldier. They saw a chance to further chip away at the right to keep and bear arms, and they took it.

Democrats are moving forward with a compromise gun control plan that would make it easier for the Federal government to confiscate Americans' guns.

Let me remind you: You swore an oath to uphold the Constitution and defend it against all enemies, both foreign and domestic. That includes a promise to stand up for the Second Amendment. Whether you like it or not, Americans have a right to keep and bear arms.

In order for the government to violate or revoke that right, the government has to prove that a gun owner broke the law. It is up to prosecutors to prove, beyond a reasonable doubt, that someone is unfit to own firearms. Until that happens, Americans are presumed innocent. The presumption of innocence is the foundation of our justice system.

But now, your colleagues are working to change this. Instead of Americans being presumed innocent, they are proposing a bill that would allow the government to presume them to be dangerous...

The Extreme Risk Protection Order and Violence Prevention Act would use American tax dollars to create a new disarmament system.

Instead of having to prove guilt beyond a reasonable doubt, the bill would allow the government to secure confiscation orders simply by convincing a judge that it is 'more likely than not' that a gun owner is dangerous. Prosecutors do not even need to charge a gun owner with a specific crime to get a judge to sign off on the confiscation raid...

Then, after the guns are confiscated, it is up to the disarmed gun owner to prove their innocence. If the judge disagrees, then the confiscation order is extended out to a year. Again, this happens without any criminal charges being filed.

This is flagrantly unconstitutional. And yet, the GOP and Dems are working together to pass it... They want to use my tax dollars to abolish the right to keep and bear arms. And since this is being structured as a spending program, this will allow them to tack their proposal onto the upcoming spending package as an amendment.

I need you to understand something: if you allow this to happen, or support it in any way, you will be violating your oath of office. If you vote for this proposal, either as a standalone bill or as an amendment, you are voting against the 2nd Amendment.

And if you vote against the 2nd Amendment, you will have to be removed from office.
