With all eyes on the Coronavirus, some of your colleagues are using this crisis to advance one of the most unconstitutional pieces of legislation ever introduced.

On Wednesday, the Senate Judiciary Committee held a hearing on the EARN IT Act. This legislation would give the government the power to force tech companies to provide a backdoor to their encryption so that the FBI, NSA, and other government agencies can spy on what Americans are doing and saying online.

The internet as we know it would not exist without Section 230 of the Communications Decency Act. This provision ensures that tech companies are not held criminally liable for the actions users take on their platforms. If someone makes a terroristic threat on Facebook, the offending user is charged with terrorism crimes, not Facebook itself. This is common sense.

The EARN IT Act would weaponize these Section 230 protections by threatening to revoke them unless websites and tech companies comply with the DOJ's list of "best practices." Of course, the list will be created at a later date but we already know that an encryption backdoor is at the top of that list.

Let me put this simply: The EARN IT Act would allow the Federal government to threaten websites and tech companies with criminal prosecution and bankruptcy unless they allow government agents to spy on what users do and say on their platforms.

This bill doesn't just chip away at the 1st Amendment, but it also slashes Americans' 4th Amendment right to be secure in their papers and effects.

It is disgusting that you colleagues have chosen to advance this legislation during the Coronavirus response. They are hoping that Americans will be too busy to realize what they are doing.

I am writing to you today to make sure you understand that I see what you are doing. You will not be able to pass this disgusting bill and get away with it.

You MUST kill the EARN IT Act. I don't care what it takes, you cannot allow this bill to become law.

You swore an oath to uphold and defend the Constitution. If you vote for this legislation, or help it pass in any way, you will be in violation of your oath and MUST be removed from office!
