Ruth Bader Ginsburg has passed away. Donald Trump has signaled that he will nominate a replacement. The stakes are just too high to go into a contested election with a 4-4 split in the Supreme Court.

GOPers are already starting to cave, however. Lisa Murkowski has said she will not support Trump's nominee, even before he or she has been named. Susan Collins has also said she would not support a nominee so close to the election. Then there is Mitt Romney, the ultimate GOP turncoat.

If one more GOPer flips, then the nomination is doomed. That is how razor thin this margin is...

Ruth Bader Ginsburg has passed away. It is important that you and your colleagues quickly confirm a replacement justice.

Both the Trump and Biden campaigns are preparing for post-election legal challenges. If this election sees a repeat of Bush v. Gore and the case goes all the way to the Supreme Court, we would face a constitutional crisis if there are only 8 Justices on the bench. This country cannot risk going into a contested election with an evenly divided 4-4 Supreme Court that is unable to make a determination.

The Supreme Court is also set to begin considering petitions next month. There are big cases that will likely be stalled because the Supreme Court will not have enough Justices to issue a final ruling. The Supreme Court will also begin hearing cases in December. These are cases that have been making their way through lower courts for years. Many of them have suffered truly heinous lower court and Appeals Court ruling that would end up staying in place if the Supreme Court becomes deadlocked without its 9th Justice... That is unacceptable.

Many of your colleagues, however, are desperate to politicize this. Even though they were demanding that Barack Obama's nominee be confirmed 4 years ago, now they have apparently changed their minds and want any nominee, no matter who it is, blocked as well.

Ruth Bader Ginsburg said back in 2016 that "there is nothing in the Constitution that says the President stops being President in his final year in office." Donald Trump is President and has a Constitutional obligation to nominate a replacement. It is your job to make sure that the Supreme Court has a full complement of 9 Justices.

We risk a legitimate Constitutional crisis this year if this seat is not filled.

You must confirm a new Supreme Court Justice this year, before the election, to ensure that the Supreme Court is equipped to deal with any and all election challenges.
