Today, the Obama administration published a proposed rule change in the Federal Registry. The citation is 81 FR 27059.

Under this regulation, the Social Security Administration will now be forwarding the list of Social Security beneficiaries with "designated payees" to the FBI for inclusion on the list of prohibited persons.

In short, if a disabled or elderly American needs help managing their finances, Obama believes they shouldn't be allowed to buy a gun.

The law is clear. There is a finite number of official disqualifiers. In order to be disqualified for health reasons, an individual must be adjudicated to be "mentally defective" in a court of law or be involuntarily admitted to a mental health facility.

Those are the only two ways that someone can be disqualified for health reasons.

What this new regulation does is it gives bureaucrats a power that the law reserves for judges.

Just because someone needs help managing finances does not mean they lose their constitutionally protected rights.

What about the disabled and elderly Americans who don't have cars or can't drive and need a family member to deposit their benefits checks or pick up their groceries? Under this proposed rule change, that elderly or disabled literature would have to surrender their firearms.

This is madness!

Right now, the Social Security Beneficiary 2nd Amendment Rights Protection Act is waiting for a vote. It has 124 co-sponsors and would stop Obama's executive order in its tracks.

An individual's financial literacy has no bearing on his or her constitutional rights.
