You swore an oath to uphold and defend the Constitution of the United States. That includes Article 2, Section 2, the Treaty Clause.

All treaties and binding international agreements require a two-thirds ratification vote in the Senate in order to become law. Except when the Obama administration was negotiating the United Nations' Paris Climate Agreement, they never bothered to seek advice or consent from the Senate.

Obama signed the agreement on his own and then began implementing its terms by executive fiat. He used the EPA to impose similar environmental restrictions on American businesses and raided the Treasury to give away $1 billion to help the UN implement its treaty abroad. All without any Congressional authorization.

What Barack Obama did was unconstitutional. He sidestepped Congress' constitutional authority to debate and ratify international agreements.

When President Trump took office, he vowed to undo all of this. He formally withdrew from the Paris Climate Agreement, stopped all of Obama's overseas payments, and rolled back the overbearing environmental regulations that the previous administration had no right to implement. But the President cannot formally withdraw until next year.

Now, your colleagues are trying to stop Trump from giving the United Nations formal notice. Tucked away in the State Department, Foreign Operations, and Related Programs Appropriations Act is a provision that blocks the administration from spending even a cent to deliver this notice. Section 7060(b)(1)(D) of the bill reads,

"None of the funds appropriated or otherwise made available by this Act, or prior Acts making appropriations for the Department of State, foreign operations, and related programs, may be used to provide formal notification under Article 28 of the Paris Agreement of the withdrawal of the United States from such Agreement."

Obama had no right to sign this agreement and Congress was never given an opportunity to debate or ratify it. But now, this amendment seeks to sidestep the Constitution once again and make the treaty permanent through just a simple majority vote.

I am demanding that you strip this language from the spending package, by any means necessary. Your colleagues are already threatening to allow a government shutdown unless you vote to surrender our sovereignty to the UN.

If you go through with that and allow this provision to pass, you are finished.

Stand up for America. Stand up for the Constitution. Stand up for the Treaty Clause.
