Mike Harky served honorably in the United States Marine Corps for eight years. He received a medical discharge, and a purple heart, after his was injured in an IED blast in Iraq.

As he was being discharged, the Marines took his rifle and gas mask, but left him the rest of his gear to keep. Mike packed his stuff up in his footlocker, shipped it home, and stored it up in his attic. He hasn't touched his footlocker in years and forgot it was even up there.

During a heated custody dispute, Harky became the subject of a Temporary Restraining Order. Police arrived at his home and secured his shotgun and the contents of his footlocker. Harky ended up winning 50% custody of his 8-year-old son and the TRO was lifted. But when he went to pick up his property at the local police station, he ended up being arrested instead.

Inside of his footlocker from Iraq, police found two 30-round magazines that he used while on deployment. Harky only owns a shotgun, he doesn't even own a rifle that takes the magazines, or the bullets to put inside of them. They are literally nothing but boxes with springs inside of them. He brought them home as souvenirs and hasn't even touched them since. They are still caked in dirt and sand from the Iraqi desert.

But New Jersey now wants to make an example of this Purple Heart recipient. Mike Harky is facing two felony counts and up to 3 years in prison for possessing "illegal" firearm magazines.
